The Master Planned Community and Condominium Practice Group of Armbrust & Brown, PLLC (the "MPC and Condo Group") concentrates on master planned community and condominium development, from inception of the project through completion and transition to owner control. Headed up by Armbrust & Brown, PLLC partner Joshua D. Bernstein, the MPC and Condo Group is comprised of five attorneys whose focus is exclusively within this practice area.
In representing condominium developers, the MPC and Condo Group prepares project documents, consumer disclosures, sales reservations and contracts and other materials relating to the creation and administration of a condominium regime. In addition, the MPC and Condo Group assists condominium developers in meeting and achieving federal financing pre-approval, e.g., FNMA and FHA, and complying with federal Interstate Land Sales Act registration and disclosure requirements. The MPC and Condo Group also advises third party service providers, e.g., surveyors, architects, and property managers, and assists in the implementation of a marketing program for the project.
In representing master-planned community developers, the MPC and Condo Group prepares the governance documents, design guidelines, rules, and community association organizational documents. The MPC and Condo Group also assists in the administration of multi-phased projects. In addition, the MPC and Condo Group assists developer clients with condominium and community association issues that arise during the developer control period and with transition of the project to resident/owner control.
Upon transition, the MPC and Condo Group is experienced with assisting the community association with a myriad of issues, including attendance at board or owner meetings, document review and interpretation, document amendment, drafting or revising association policies, rules or regulations, building or facilities renovation, and easement, license, title or other real property issues affected by government or agency regulations. In addition, the MPC and Condo Group assists associations with maintaining their facilities and continued financial well-being through enforcement and collection procedures and proceedings.
